TERMS AND CONDITIONS OF SALE

Unless otherwise agreed in writing, the sale, delivery, repair and service of all goods supplied by Pedarson LTD will be subject to the following terms and conditions:

DEFINITIONS:

The 'Company' refers to PEDARSON LTD

The 'Buyer' means the person, individual or Company contracting to buy Goods. The 'Goods' means the goods the Buyer contracts to buy, which may be specified in the order acknowledgement or other appropriate document and includes where applicable units, parts, accessories, repairs and service.

02. TERMS OF DELIVERY

Delivery is ex works, and shall be deemed effective when the Goods are declared available for dispatch or collection.

03. PRICES

The prices shown are only applicable to purchases made via the Company and are shown in Pounds Sterling. Any VAT charges are displayed during the initial phase of shopping before any payment details are entered and can be calculated for the contents of your shopping cart or other means of ordering. In the event of a pricing error, we reserve the right to cancel any online order before the goods are shipped.

04. PAYMENT AND INTEREST

Payment can be made either by credit card or cheque with guarantee card, or the Company may agree other forms of payment. All goods remain the property of the Company until paid for in full. With regard to online payments, your personal details are collected and processed on our secure server. The secure servers encrypt your details when they are sent over the internet and they are then decrypted on receipt. Please look for the small padlock icon displayed on your web browser when you reach the checkout page. You can verify the validity of the security license by double clicking on the padlock.

The Company reserves the right to charge interest on any overdue outstanding accounts.

05. RETURNED or DAMAGED OF GOODS

(a) The Company will refund or replace at no extra cost any products damaged before or on delivery, providing you notify us by telephone or in writing within 7 days of receipt of any such damaged goods.

(b) We will replace at no extra cost any products which have been lost in transit providing you notify us by telephone or in writing within 7 days of us receiving your order or the delivery date of the products, whichever shall be the later.

(c) Cancellation

The buyer has the right to a fourteen-day cooling off period, commencing the day after goods are received, in which to cancel their order for whatever reason. Should the customer choose to exercise these rights they must return any goods supplied to them.

Before goods are returned, you must contact us to obtain a Goods Return Form, which must be completed and returned to us before an Authorisation Number will be issued. No goods will be accepted unless an authorisation number has been issued by the wetroom store.

Your money will be refunded (by the same method as payment), less the initial delivery costs*, within 30 days of cancellation. You are responsible for the returning of the goods to us.

After 15 days of delivery, a handling charge of 15% will be applied for the returning of unused goods.

After 30 days of delivery, a handling charge of 25% will be applied for the returning of unused goods.

No refunds will be permitted for goods returned which are not returned in the original undamaged packaging and in perfect/ re sellable condition complete with all manuals & accessories supplied with the original kits.

Should goods be returned without the security seals intact, the goods will be subject to a re-testing procedure and the buyer will be advised of the associated charge.

* Delivery costs are calculated at £12.00 inc VAT for the 1st 10Kg and £0.60 inc VAT for every 1Kg in excess of the 10Kg.

FAULTY GOODS

Any item being returned for repair or replacement under warranty MUST be purchased directly from Pedarson LTD. If purchased through wholesalers, stockists or any other third party, the end user MUST contact these companies directly for warranty claims.

Items that are deemed none repairable are to be replaced, provided the cause of fault is within acceptable warranty terms.

We are not liable to find alternative temporary replacement while your item is being repaired.

We'll check all items returned as damaged or defective. In the event we find no fault, we reserve the right refuse a refund and to recover our fees and expenses from you.

Customers are responsible for the safe return of the item and primarily the cost of return.

Heatmiser Products

All Heatmiser products are supplied with a 2 Year Return to Base Warranty. Return to base means that the item must be returned to Heatmiser UK for inspection/repair or replacement if a fault develops within the warranty period.

06. CLAIMS

(a) DESIGN

It is entirely the Buyer's responsibility to ensure that the Goods supplied are suitable for the particular purpose intended. In placing an order the Buyer acknowledges that it has not been induced by any representation by or on behalf of the Company, which has not been confirmed in writing to or by the Company. Should the Buyer effect onward sale or supply to a third party, all products must be delivered in the original packaging, instructions and labelling.

(b) LIABILITY FOR INSTALLATION AND USE

The Company shall not be liable for any defect or damage arising from overheating or corrosion other than where a design has been supplied (in writing) by the Company and installation/application instructions have been correctly implemented. The Company shall not be liable in the event that the Buyer's use of the Goods is contrary to any general standards or regulations in force from time to time. Furthermore, the Company shall not be liable for any defect or damage arising out of improper use, misuse, incorrect/improper installation, or any other damage arising from any application contrary to generally acknowledged best practices.

The Company will not be liable for any consequential loss or damage howsoever caused.


07. COMPLAINTS PROCEDURE

We endeavour to respond to all complaints promptly, and if we need to investigate your query further we will advise you.


08. SPECIFICATIONS

Specifications, indications of performance and other descriptions in the Seller's catalogues, brochures, price lists and advertising material are based on test conditions. Actual performance depends on the power supply, the environment and installation conditions. The Company does not warrant performance to these specifications in each installation. The Company reserves the right to alter the specification and modify Goods as part of regular product development in accordance with the applicable quality standards and provisions resulting in variations of performance specifications and other descriptions.

10. RETENTION OF TITLE

Any design, drawing, description model, sample and/or the like shall remain the absolute property of the Company and the Buyer shall, if so requested by the Company, return such design, drawing, description, model, sample and/or the like to the Company. The Buyer shall have no right to use or transfer or assign any drawing, description model, sample and/or the like to any third party without the prior written consent of the Company.


11. PRIVACY POLICY

The Company does not disclose buyer's information to third parties. Cookies are used in our site, but these are only used to keep track of your shopping trolley contents once you have selected an item. Any information given at the time of ordering is collected by us for the sole intention of completing your order. We may collect information to enable us to inform you from time to time, by e-mail or post, of new products and services available from the company. All information is collected lawfully and in accordance with the Data Protection Act of 1998


12. LAW

Any and all disputes arising between the Company and the Buyer will be subject to settlement under English Law.
